REGULAR COUNCIL MEETING Monday, February 5, 2024 – City Hall 7:00 p.m. The Ute City Council met with Mayor Henschen in regular, open session on Monday, February 5 at 7pm in the Council Chambers, City Hall with the following council members present: Jimmy Carlson, Josh Gotto, Sue Kelm.  Absent: Matt Leitz, Ryan Pithan. Also Present: City Clerk Megan Peitsch, Public Works Superintendent Lonnie Carlson, Hank Buschmann, Adam Eggeling. The meeting was called to order at 7:00pm by Mayor Henschen. Motion by JCarlson/Gotto to approve the agenda. All Ayes. MC Adam Eggeling from Charter Oak-Ute Public School presented a proposal to move the primary school bus pick-up location to the Ute Town and Country parking lot. The pickup location has been added to the School’s insurance and required signs will be added at the school’s expense. Motion by Gotto/JCarlson to accept the proposal. All Ayes. MC. Clerk will prepare update for Municipal Code for next meeting. Temporary signs will be in place at pickup location starting February 20, 2024. A formal complaint from Hank Buschmann was considered and a first violation letter will be sent. Public Forum had no speakers. Mayor Henschen presented ideas on establishing rental property standards/inspections and research into the annexation process to expand town limits. These topics will be discussed more at future meetings. Public Works Superintendent Lonnie Carlson gave an update on the Water Tower Project and well rehabilitation. City Clerk gave reports on the financials for the City and utility billing reports. A public hearing will be set for March 4, 2024 at 7pm – City Hall for a FY2024 Budget Amendment. One utility customer requested a hearing at a later date and the Mayor will represent the City and conduct the hearing according to our code. Motion by Kelm/Gotto to approve the consent agenda consisting of: Approval of January 2023 Bills and Payroll, Approval of City Council Minutes 1/10/2024 Regular Meeting and 01/24/2024 Special Work Session, Approval of Pay App 5 Group B. All Ayes. MC. Motion by Gotto/JCarlson to approve the resolution adopting a citizen complaint policy (RESOLUTION # 2024-10). All Ayes. MC Motion by Kelm/Gotto to approve the resolution to establish a petty cash fund and policies on use thereof (RESOLUTION 2024-11). All Ayes. MC Motion by JCarlson/Gotto to approve the resolution for American Rescue Plan Act (ARPA) Allocation (RESOLUTION 2024-12). All Ayes. MC Motion by Gotto/Kelm to set a public hearing for the CDBG Status of Funded Activities for March 4, 2024 at 7pm – City Hall. All Ayes. MC Motion by JCarlson/Gotto to set a public hearing for the Property Tax System FY2025 for April 3, 2024 at 6:00 pm – City Hall. All Ayes. MC Motion by Gotto/JCarlson to approve the Triple C Pest Control Contract for Mosquito Control treatments and authorize pre-payment. All Ayes. MC Motion by JCarlson/Gotto to approve using Iowa Codification for the Recodification process. All Ayes. MC Motion by Gotto/JCarlson to approve the Water Tower Change Order No. 1 for Generator (decreased cost) and direct the Mayor Pro-Tem to sign. All Ayes. MC Motion by Kelm/JCarlson to approve the final reading of ORDINANCE 226: An Ordinance to Amend the Ute Municipal Code, 2017, Title VI – Physical Environment Chapter 5 Utilities – Billing Charges, Section 6-5-8 Water Rates. Roll Call Vote. Ayes: JCarlson, Kelm, Gotto. Nays: None. Absent: Leitz, Pithan. Ordinance 226 duly adopted upon publication. Motion by JCarlson/Gotto to approve the final reading of ORDINANCE 227: An Ordinance to Amend the Ute Municipal Code, 2017, Title VI – Physical Environment Chapter 5 Utilities – Billing Charges, Section 6-5-10 Rate of Sewer Rent and Manner of Payment. Roll Call Vote. Ayes: JCarlson, Kelm, Gotto. Nays: None. Absent: Leitz, Pithan. Ordinance 227 duly adopted upon publication. Motion by Gotto/Kelm to table the third reading of Ordinance 228 due to no quorum available as one present Council member is required to abstain. All Ayes. MC. The third and final reading of Ordinance 228 is tabled until the March 4, 2024 regular council meeting. Discussion was held on repairing the tornado siren. Lonnie Carlson stated that we are on a waiting list for repair. Mayor has another contact and will reach out for a price and estimated time frame to present at next meeting. Discussion was briefly held on the Shift Differential draft resolutions. Resolutions will be on March meeting agenda. Discussion on Ute Clean Days was held. Clean Up Days will be May 10-12, 2024 at the Town and Country. Many appliances were dumped in last year’s dumpsters without tags causing the City. Appliance Tags will be available at City Hall starting 2 weeks prior. Primary Election will be held on Tuesday June 4, 2024 at City Hall. Polls are open from 7am – 8pm.
