City of Ute September 11, 2023 Mayor Hagemann called the regular council meeting to order on Monday, September 11, 2023 at 7:00 pm in the Council Chambers, City Hall with the following council members present: Pithan, Leitz, Carlson, Gotto; absent: Miller. Motion by Carlson, second by Gotto to approve the agenda. All in favor, motion caried. Motion by Leitz, second by Gotto to approve the tax exemption certificate for the Water Revenue Capital Loan Notes Anticipation Project Note, Series 2023 be placed on file. All ayes, motion carried. Motion by Leitz, second by Gotto to approve the resolution authorizing the issuance of $1,760,000 Water Revenue Capital Loan Notes Anticipation Project Note, Series 2023. All ayes, motion carried. Building permits approved: Compass Rose – commercial building; Mark Bretthauer – shed; Larry Kastner – pad & garage; Pohlman – 2 conex storage containers and concrete pad addition. Council discussed the installation of sampling taps. All in favor to go forward with installation. Discussion was held on a building permit submitted by Briar Buscho. Mr. Buscho said he intends to put 4 conex boxes on the property located on Railway Street. The conex boxes will be enclosed or painted and have a roof installed to cover the conex boxes. Council approved the building permit with all in favor. Gary Goslar informed the Council that the Fire Association may possibly apply for a forestry grant and asked if the City would provide matching funds. The grant money would be used to obtain two-way radios or gear for wildland fires. Council asked that Mr. Goslar obtain additional information and narrow down what the funds will actually be used for and to present the topic again at the October 2023 regular meeting. No action taken. Motion by Pithan, second by Leitz to approve the consent agenda. All ayes, motion carried. Motion by Carlson, second by Pithan to approve Trick-or-Treating time from 4:00 PM – 7:00 PM on Tuesday, October 31, 2023. All ayes, motion carried. Motion by Leitz, second by Carlson to approve the Library Boards recommendation to appoint Lisa Pithan to the Library Board. Ayes: Gotto; Abstain: Pithan; Absent: Miller. Motion carried. Discussion was held on water bills in arrears. Council approved to resume shutting off water for unpaid utility bills. Discussion was held on the City Credit. The current credit card is in a former Mayor’s name. Motion by Leitz, second by Pithan to cancel the City Credit Card and apply for a new credit card in the City’s name. All ayes, motion carried. Discussion was held on who all had access and the location of keys to the City’s mailbox. Leitz stated the importance of City staff checking the mail daily. No action taken. Motion by Leitz, second by Pithan to approve the City Clerk to contact Advance Communication System (ACS) to become the City’s new email provider. All ayes, motion carried. Motion by Leitz, second by Gotto to approve opening a construction account with United Bank of Iowa for the Water System Project. All ayes, motion carried. At the regular City Council Meeting held on August 7, 2023. The City Clerk was placed on a 60-day probationary period. Performance measurements for the probationary period included providing City Council with bank reconciliations, utility reconciliations, monthly clerk reports, payroll reports, a listing of all claims to be approved by the City council, prior month’s meeting minutes and that all claims against the City be paid in a timely manner (within 30 days) and that all meeting minutes, public notices and other publications be submitted to the press in accordance with the Code of Iowa. Motion by Leitz, second by Carlson to terminate Leah Schwery as City Clerk effective immediately due to failing to meet the performance measurements set out in the August 7, 2023 regular City Council meeting. All ayes, motion carried. Carlson called Megan Peitch, Assistant City Clerk, and asked that she join the meeting. Upon Mrs. Peitch arrival Council informed her of their decision to terminate Leah Schwery as City Clerk. Mrs. Peitch agreed to be acting City Clerk, effective immediately. Discussion was held on steps necessary to look for a permanent replacement at City Clerk Special meeting set for Wednesday, September 13, 2023, 7:30 pm at City Hall. Next Regular meeting set for Monday, October 2, 2023 at 7:00 pm at City Hall. Motion by Pithan, second by Gotto to adjourn. All ayes, meeting adjourned at 8:13 PM.
