City of Ute REGULAR COUNCIL MEETING Monday, October 2, 2023 – City Hall 7:00 p.m. – The Ute City Council met with Mayor Hageman in regular, open session on Monday, October 2, 2023 at 7pm in the Council Chambers, City Hall with the following council members present: Jimmy Carlson, Josh Gotto, Matt Leitz, Becky Miller, Ryan Pithan. Also Present: Acting City Clerk Megan Peitsch, Public Works Superintendent Lonnie Carlson, Meghann Sudsbury, Ethan Joy-JEO The meeting was called to order at 7:00pm by Mayor Hageman. Motion by Gotto, seconded by Miller to approve the agenda. All ayes. MC Meghann Sudbury spoke to the council regarding a Stinn bill she received for damage to water main line repair. Motion by Leitz, seconded by Jimmy Carlson to pay $200 towards the repair bill payable to Stinn Backhoe directly once Sudsbury gives a copy of the bill to City Hall. All ayes. MC Ethan Joy from JEO introduced himself as the new Project Manager for the Water Tower Project. He gave a brief update on the current status. Work has begun. Generator work has begun with mobilization on the tower and foundation coming soon. Joy shared three action items: Geotechincal Proposal for soil compaction and concrete testing for the water tower project and pay applications from King Construction and Maguire Iron. Motion by JCarlson, seconded by Gotto to accept and sign the Geotechnical Proposal from Certified Testing Services. All ayes. MC Motion by Pithan, seconded by Miller to accept and sign Pay Application 1 for Group A. All ayes. MC Motion by Gotto, seconded by Leitz to accept and sign Pay Application 1 for Group B. All ayes. MC No building permits approved Lonnie Carlson spoke on the water plant doors requirement per the Iowa DNR. LCarlson also spoke to the water tower project stating that the main line boring should be done this fall, but the service lines will not. Motion by Miller, seconded by Pithan to approve the consent agenda Approval Minutes for September 11, 2023 Meeting (Regular Council Meeting) Approval Minutes for September 13, 2023 (Special Council Meeting) Approval Minutes for September 20, 2023 (Emergency Council Meeting) Approval Minutes for September 22, 2023 (Special Council Meeting) Approval of Paid July 2023 Bills All ayes, MC Discussion on the bills from September 2023 was held. Motion by Gotto, seconded by Miller to approve payment of all scheduled claims except Barkley Asphalt who said they could be paid next month. All ayes, MC. Discussion of letter from lawyer dated 09/14/2023. A response letter was discussed and will be sent to the lawyer. Motion by Gotto, seconded by Pithan to have the Mayor, Mayor Protem, and City Clerk sign the Authorization Form from Simpco. All ayes, MC Motion by Miller, seconded by Gotto to approve of all past bills from Simpco in regards to the water tower project and approval of all future bills to be paid in regards to the current water tower project. All Ayes. MC Motion by Leitz, seconded by Pithan to sign the Acknowledgement of Notice to Proceed issued August 23, 2023 and send to the contractors. All Ayes. MC ACS Email Proposal was tabled to the next meeting until Bank reconciliations are done. Metering and Technology Training Proposal one day on-site training was discussed. Motion by Miller and seconded by JCarlson to approve the proposal and schedule the training after the hiring of a new city clerk. All ayes. MC CHN Increasing Rates discussion was tabled to the next meeting with more detailed information. Ute Town and Country was not previously metered. Discussion was held on how the water billing should work. Contact information was updated for all City Council members and the Mayor. Acting City Clerk Megan Peitsch gave a city clerk report. Discrepancies were found in the accounting software regarding payroll, accounts payable, and general ledger. Financial reports from the system are not able to be run with accuracy at this time. City council will allow Shannon Hahn to work up to 4 hours to help setup a filing system. Peitsch brought up requesting overtime, but no decision was made. Pithan and Miller will meet later this week to locate and record missing minutes for publication. Motion by Gotto, seconded by Pithan to approve RESOLUTION 2023-30 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UTE, IOWA APPROVING TEMPORARY SALARY ADJUSTMENT OF PART-TIME CITY CLERK MEGAN PEITSCH FOR THE DURATION OF HER SERVICE IN THE POSITION OF ACTING CITY CLERK. Peitsch will receive 18.00 per hour effective 09/12/2023 until the time of the hiring of a new clerk at which time it will revert back to her regular pay of 12.00 per hour. All Ayes. MC City Council will review applications for City Clerk on Oct 16th at 7pm at City Hall. Motion by Gotto, seconded by Miller to move to Closed Session for one employee performance review – The employee has requested closed session. Closed Session Under Iowa Code 21.5(1)(i) to evaluate the professional competency of an individual whose appointment, hiring, performance, or discharge is being considered when necessary to prevent needless and irreparable injury to that individual’s reputation and that individual requests a closed session. All ayes. MC City Council entered into closed session at 8:52pm. The detailed minutes and recording have been sealed in accordance with Iowa Code 25.1(5). City Council returned to open session at 9:20pm. Discussion on Public Works Superintendent job description. City Clerk and Lonnie Carlson will create a draft of an ordinance for proposed changes to job description for the Public Works Supervisor in the Municipal Code to better reflect actual job description for review at the November regular council meeting. The City of Ute is currently hiring for the position of part time City Clerk. Job description and application are available at www.cityofute.com and at City Hall. Applications due October 13, 2023. Trick or Treating hours for the City of Ute will be on October 31st from 4:00pm – 7:00pm General Election will be held on Tuesday, November 7, 2023 from 7am- 8pm at City Hall. Next Regular Meeting set for Monday, November 6, 2023 at 7:00 p.m. at City Hall Gotto mentioned that there may be land for sale to use for truck parking. No action taken.
