City of Ute REGULAR COUNCIL MEETING Monday, April 3, 2023 – City Hall 7:00 p.m. The Ute City Council met with Mayor Richard Hageman in regular, open session on April 3, 2023. Council members present: Becky Miller, Matt Leitz, Jimmy Carlson, Josh Gotto. Also present: Jan Larsen and Lonnie Carlson. Absent: Ryan Pithan Motion by Gotto/Carlson to approve the agenda. All Ayes, MC. 7:00 – Public Hearing Construction of 2022 Water System Improvements, CDBG Project No. 21-WS-008 -Public hearing on the matter of the adoption of plans, specifications, form of contract and estimate of cost of construction. No written or verbal objections from the public. No written or verbal objections from the public. -Motion by Gotto/Miller to approve Resolution adopting plans, specifications, form of contract and estimate of costs . All Ayes. MC. Mayor declared Resolution Adopted. Public hearing on Maximum Proposed Property Tax Levy. No written or verbal objections from the public. Motion by Carlson/Leitz to approve Resolution 2023-16 – A Resolution to approve the maximum tax dollars from certain levies for the City’s proposed Fiscal Year 2023-2024 Budget. All Ayes. MC Mayor declared Resolution Adopted. Public Forum- Jan Larsen had fireworks complaint about fireworks going off between 9:30pm on 10pm on weekends in violation of ordinance. Grain trucks speeding on street where children play. Motion by Gotto/Carlson to close the public hearing at 7:10pm. All Ayes, MC Building Permits Approved: None Motion by Gotto/Miller to approve purchasing the materials and having the roof replaced at City Hall for an estimated cost $26,175. Miller, Carlson, Gotto Ayes. Leitz abstained. MC Ute Post Office roof replacement estimate was $14,725. Will discuss doing post office roof replacement until next fiscal year budget. Consent agenda tabled until April 19, 2023 meeting due to accounting software problem. A. Minutes for March 7, 2023 Meeting B. Approval of March 2023 Bills Motion by Carlson/Leitz to approve FY2024 Budget for publication and set Public Hearing for Wednesday April 19 at 7:00pm at City Hall. All Ayes. MC. Motion by Carlson/Gotto to set Public Hearing on Construction of 2022 Water System Improvements, CDBG Project No. 21-WS-008 Consideration of construction bids and Resolution Designating Low Bidder for Monday May 1, 2023 7:00pm at City Hall. All Ayes. MC. Motion by Leitz/Carlson to approve Triple C Mosquito Spray (16 treatments) Contract for $1,995. All Ayes. MC. Motion by Leitz/Miller to authorize the Mayor to sign the pre-application for the USDA Community Facilities Grant for purchase of utility trailer and John Deere Gator. All Ayes. MC Motion by Leitz/Gotto to approve website renewals of domain, website security, and Managed Word Press. All Ayes. MC City Clean-up Days will be May 5th – 8th, 2023. No curbside pickup. Dumpsters will be at the Ute Town and Country. Appliance Tags available for purchase at City Hall. Reminder: Mowing Ordinance 3-2-3.8: MOWING OF PROPERTIES. Any property within the City of Ute, whether vacated or non-vacated, is required to be mowed any time the vegetation reaches a height of more than 8 inches in April, May, June, July, August, September, October of each year. PENALTY. The City of their agents may mow any property which is not mowed by the above date, and a charge of $75.00 per hour for such mowing, plus a surcharge of $100.00, will be charged to the property owner. Any property owners who fail to mow their properties, thus allowing the same to be mowed by the City or their agents, and who do not provide payment for the mowing as required, will be assessed by the City for such costs, which will be collected in the same manner as general property taxes.
