City of Ute REGULAR COUNCIL MEETING July 11, 2022 – City Hall The Ute City Council met with Mayor Richard Hageman in regular, open session on July 11, 2022 at 7:00 p.m. Council members present: Becky Miller, Ciera Carlson, Ryan Pithan, Jimmy Carlson, and Matt Leitz. Also present: Marvin Koch, Greg Iverson, Briar Buscho, Cindy Nepper, Brad Gosch, Linda Seieroe, Tanis Watke, Jeanie Erlemeier, and Lonnie Carlson. Motion by Miller/Pithan to approve the agenda. All ayes. MC 7:00 p.m. Mayor Hageman opened Public Hearing to Consider Rezoning All of Block (5) from Residential and Commercial to Heavy Industrial. Briar Buscho discussed possible plans, including landscaping to dampen noise from grain bins, for the property if rezoning is approved. Clerk stated no written protests were filed and the Zoning Board recommendation was to approve rezoning of all of Block (5) from Residential and Commercial to Heavy Industrial. Greg Iverson spoke against rezoning the property in public forum. He stated he was concerned that someone else could buy the property in the future and put whatever they wanted there if rezoning is approved. Brad Gosch and Cindy Nepper spoke against rezoning the property in public forum as they were concerned that it would have a negative effect on the value of surrounding properties. With no further comments from the public, Mayor Hageman closed the public hearing at 7:34pm. Jeanie Erlemeier discussed a written complaint that she filed regarding an incident with the librarian on election day. Building permits approved in June: none. Motion by Miller/Leitz to purchase a water meter pit for $850.00. All ayes. MC Lonnie discussed putting in a parshall flume flow meter to replace the v-notch weir at the lagoon and that it would require an engineer and permits. He stated he would get a rough estimate of the cost for the next meeting. Motion by Miller/Leitz to approve consent agenda. a. Approval of Minutes for July 11, 2022 Meeting b. Approval of July 2022 biills c. Approval of tobacco permits for Sparetime and Ampride 11 d. Approval of Liquor License Renewal for Ada J’s Steakhouse and VFW. All Ayes. Motion carried. Motion by Pithan/JCarlson approve the first reading of Ordinace 223- An Ordinance rezoning an area within the City of Ute, Iowa, from Residential (R) and Commercial (C) District to Heavy Industrial (HI). All Ayes. MC Motion by Pithan/JCarlson to waive the 2nd and 3rd readings and adopt Ordinance 223. Ayes: Miller, Leitz, Pithan, CCarlson, JCarlson. Motion carried. Ordinance 223 is adopted. Motion by Pithan/Leitz to approve the Community Catalyst Agreement Amendment. All Ayes. MC Terms for the Development Agreement for lots on Main Street were discussed. Motion by Miller/Leitz to approve Resolution 2022-15: A resolution appointing a representative to the housing authority of the City of Ute and Northwest Iowa Regional Housing Authority. Leah Schwery was appointed. All Ayes. MC Outstanding Debt Report was submitted to the State. Motion by Pithan/Leitz to approve Resolution- 2022-16: A RESOLUTION SETTING SALARIES/WAGES FOR EMPLOYEES OF THE CITY OF UTE FOR THE FISCAL YEAR JULY 1, 2022-JUNE 30, 2023. Lonnie’s wage set to $24.75 per hour and Leah’s at $18.50 per hour. Part-time and season wages to remain the same. Ayes: Pithan, Leitz, Miller, CCarlson. Abstain: JCarlson. Motion carried. The Ute Housing Corporation has senior apartments available for rent (ages 55 and up or disabled). One bedroom. $350 per month plus deposit. Section 8 available. No smoking. Ute Fire Fighters sponsoring BBQ and Auction on Sunday, August 28, 2022, at the Ute Town & Country, to help with medical expenses for volunteer members Jimmy Carlson and Sheldon Christopherson. Meal at 5pm (Free Will Donation) and Auction at 6pm. The next regular meeting set for Monday, August 1, 2022, 7:00 p.m. at City Hall. Motion by CCarlson/Leitz to adjourn the meeting at 7:55 pm.
