City of Ute SPECIAL COUNCIL MEETING Monday, October 14, 2024 – City Hall 7:00pm The Ute City Council met with Mayor Henschen in special, open session on Monday, October 14, 2024 at 7:00pm in the Council Chambers, City Hall with the following council members present: Jimmy Carlson, Josh Gotto, Sue Kelm, Ryan Pithan. Absent: Matt Leitz. Also Present: City Clerk Megan Peitsch, Public Works Superintendent Lonnie Carlson, Ethan Joy – JEO, David King – King Construction The meeting was called to order at 7:00pm by Mayor Henschen. Motion by JCarslon/Gotto to approve the agenda. All Ayes. MC Motion by Gotto/Pithan to approve the resolution for $1,760,000 Water Revenue Capital Loan Notes, Taxable Series 2024 - Approving and authorizing a form of Loan Agreement and authorizing and providing for the issuance of Taxable Water Revenue Capital Loan Notes and providing for a method of payment of the Notes (RESOLUTION #2024-38). All Ayes. MC Ethan Joy from JEO and David King from King Construction were both on hand to answer any questions on the proposed Change Order 4 and Group B Pay App 11. After discussion, there was a motion by Pithan/Kelm to approve Change Order #4. Ayes – Pithan, Kelm. Nays: JCarlson, Gotto. Motion Failed. Motion by Gotto/JCarlson to have JEO create a revised change order based on the recommendation of council, subject to USDA approval. All Ayes. MC Motion by Gotto/Kelm to sign the Interim Construction Loan Extension Agreement with UBI. All Ayes. MC Motion by JCarlson/Pithan to approve using the Draft Engineering Agreement with JEO for the USDA SEARCH GRANT. All Ayes. MC Motion by JCarlson/Gotto to approve having JEO create a change order with a second gate entrance for the water tower fence. All Ayes. MC Motion by Gotto/JCarlson to adjourn at 7:38pm. All Ayes.
