City of Charter Oak ORDINANCE NO. 198-24 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF CHARTER OAK, IOWA, BY AMENDING PROVISIONS PERTAINING TO SOLID WASTE SERVICE CHARGES BE IT ENACTED by the City Council of the City of Charter Oak, Iowa: SECTION 1. SECTION MODIFIED. Section 3-4.212(1) of the Code of Ordinances of the City of Charter Oak, Iowa, is repealed and the following adopted in lieu thereof: 3-4.212 COLLECTION FEES. The collection and disposal of solid waste as provided by this article is declared to be a benefit to the property served or eligible to be served and there shall be levies and collected fees therefore in accordance with the following: Schedule of Fees. A. A fee for maintaining a solid waste landfill in Crawford County, Iowa shall be collected by the City, in addition to any contractual obligation the City may have incurred to maintain the solid waste landfill at the following rates within the City: (1) A fee of $5.00 per month per occupied residential property owner or occupant, whether or not the property owner or occupant avail themselves of the service or use of the solid waste landfill in Crawford County, Iowa. (2) The fee may be collected in the same manner as the fees for water and sewer usage are collected. B. The fees for solid waste collection and disposal service, used or available, are: (1) For each residential premises and for each dwelling unit of a multiple-family dwelling - $15.00. SECTION 2. SEVERABILITY CLAUSE. If any section, provision, or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision, or part thereof not adjudged invalid or unconstitutional. SECTION 3. WHEN EFFECTIVE. This ordinance shall be in effect from and after its final passage, approval, and publication as provided by law.
