NOTICE OF HEARING ON PROPOSED REPAIRS DRAINAGE DISTRICT No. 36 OLIVER LAKE LATERAL No. 2 MONONA COUNTY, IOWA TO: Monona County Engineer, Oliver Lake Drainage District, all owners, encumbrancers, lienholders, unknown heirs and claimants by will, and to all others to whom it may concern, including actual occupants of all the lands within Drainage District No. 36 Oliver Lake Lateral No. 2. YOU AND EACH OF YOU ARE HEREBY NOTIFIED that the Board of Supervisors of Monona County, Iowa, acting as Trustees on behalf of Drainage District No. 36 Oliver Lake Lateral No. 2 in said county has employed Jacob Hagan, P.E. of AgriVia as an engineer to make surveys and investigations to determine the feasibility or the necessity of having repairs, all concerning the drainage facilities of Drainage District No. 36 Oliver Lake Lateral No. 2 in order to provide adequate drainage and relief for the lands included in said District. YOU ARE FURTHER NOTIFIED that drainage engineer Jacob Hagan, P.E. has filed an Engineer's Report on the 7th of July, 2026, with the Monona County Auditor setting forth a detailed description of his findings, showing that repairs to the facility are necessary to reestablish the drainage capacity and efficiency of DD36 Lateral No. 2 to that no greater than the original design and construction. The repair option and the engineerís estimate for the costs of the proposed repair is shown below: Repair Project Construction Costs: $60,000.00 Other Non-Construction District Costs: Engineering/Permitting: $10,000.00 Damages: $1,000.00 Construction Admin & Survey: $7,500.00 Warrant Interest: $7,500.00 Total Estimated Project Costs: $86,000.00 YOU ARE FURTHER NOTIFIED that this report with recommendations is on file in the office of the Monona County Auditor ñ Drainage Office, Courthouse, 610 Iowa Avenue, Onawa, Iowa, 51040. The Engineer's Report outlining repairs was tentatively approved by the Board of Supervisors on July 7, 2026. For further particulars you are referred to the Engineer's Report viewable on Monona Countyís website at https://mononacountyiowa.gov/drainage/projects/ or may be obtained via email by contacting the Monona County Auditor's Drainage office at mocodr1@mononacountyiowa.gov. YOU ARE FURTHER NOTIFIED that the Board of Supervisors of Monona County, acting on behalf of Drainage District No. 36, Oliver Lake Lateral No. 2 has fixed a time and place of hearing on said report and proposed repair, for the 25th day of August 2026, at 10:00 A.M. in the Board of Supervisorís Meeting Room at the Monona County Courthouse in Onawa, Iowa. At said hearing the Board of Supervisors shall hear objections to the feasibility of such repairs of the Drainage District as may be presented by and for any landowner in the District. The report of the engineer as filed may be amended before final action is taken thereon by this Board of Supervisors. This hearing may be continued from time to time without further notice as determined by this Board of Supervisors. YOU ARE FURTHER NOTIFIED THAT ALL OBJECTIONS TO THE ENGINEERíS REPORT OR TO ANY MATTER CONNECTED WITH THIS HEARING MUST BE IN WRITING AND FILED WITH THE MONONA COUNTY AUDITOR-DRAINAGE OFFICE AT OR BEFORE THE DAY FIXED FOR HEARING. Any interested party may be heard in an argument by himself or by counsel. Anyone who fails to object in writing shall be held to have waived all objections and claims for damages. Any interested party may file a written supporting statement with the Auditor, at or before the date for hearing. YOU ARE FURTHER NOTIFIED that the Board will also consider the interest rate for this project and may consider installment payments and length of time that assessments may be paid of not less than ten (10) nor more than twenty (20) years. YOU ARE FURTHER NOTIFIED that if you fail to object, the Board of Supervisors can make a final decision to make repairs as recommended by the engineer or as modified by them. As a consequence of your failure to object you lose your right to appeal the final decision within twenty (20) days to the Iowa District Court.
