NOTICE OF HEARING ON PROPOSED REPAIRS-DEBRIS REMOVAL NAGEL DRAINAGE DISTRICT OF MONONA COUNTY, IOWA TO: Monona County Engineer, all owners, encumbrancers, lienholders, unknown heirs and claimants by will, to all whom it may concern, including the actual occupants of the land, or tract of land, described in and including the Nagel Drainage District of Monona, Iowa. YOU AND EACH OF YOU ARE HEREBY NOTIFIED that the Trustees of the Nagel Drainage District have employed Caleb Rasmussen, PE of ISG as an engineer to make surveys and investigations to determine repairs necessary to remove debris in order to maintain proper operation of the levees. The Nagel Drainage District has applied for federal cost share through the Federal Emergency Management Agency. YOU ARE FURTHER NOTIFIED that the estimated construction costs to be assessed to the district are not expected to exceed the competitive bid threshold and therefore no engineer’s report has been made (468.126.1.c). As such the Board of Trustees has directed the engineer to obtain competitive quotations, which will be considered following this hearing. The estimated cost of repairs, as well as expected funding cost share, is summarized below. Debris Removal Project Costs Subtotal: $497,300.25 Federal Cost Share (75%): -$372,975.19 State Cost Share (10%): -$49,730.03 Estimated District Cost: $74,595.04 YOU ARE FURTHER NOTIFIED that the Board of Trustees of the Nagel Drainage District has fixed a time and place of hearing on said proposed repairs, on April 16, 2022, at 9:00 AM, at the Drianage Office, Monona County Court House at 610 Iowa Avenue in Onawa, Iowa. At said hearing the Trustees shall hear objections to the feasibility of such debris removal as may be presented by and for any landowner in the District. This hearing may be continued from time to time without further notice as determined by the Board of Trustees. YOU ARE FURTHER NOTIFIED that all objections to any matter connected with this hearing must be in writing and filed with the Monona County auditor at or before the day fixed for hearing. Any interested party may be heard in an argument by himself or by counsel. Anyone who fails to object in writing shall be held to have waived all objections and claims for damages. Any interested party may file a written supporting statement with the Auditor, at or before the date for hearing. YOU ARE FURTHER NOTIFIED that if you fail to object, the Board of Trustees can make a final decision to make repairs as recommended by the engineer or as modified by them. As a consequence of your failure to object you lose your right to appeal the final decision within twenty (20) days to the Iowa District Court.
