NOTICE TO BIDDERS For Open Ditch Repairs, Oliver Lake Drainage District Main & Lateral Nos. 2 & 3, Monona County, Iowa General Nature of Public Improvement: The project consists of open ditch repairs to the Oliver Lake Drainage District Main, Lateral No. 2, and Lateral No. 3 in Monona County, Iowa. Work includes approximately 37,000 CY of ditch excavation with spoil leveling, tillage, and seeding across 396 stations; approximately 990 LF of 18"–36" CMP surface drains with flap gates; and 250 LF of 48" and 84" CMP pipe culverts installed by open cut within Monona County secondary road right-of-way. The project shall include all labor, equipment, materials, and incidental items necessary to complete the work in accordance with the plans and specifications. Time and Place for Filing Sealed Bids: Sealed bids for the work comprising the repairs as stated below must be filed before 10:00 A.M. on September 22nd, 2026 in the office of Monona County Drainage, Courthouse, 610 Iowa Ave, First Floor, Onawa, IA 51040 Time and Place Sealed Bids Will be Opened and Considered: Sealed bids will be opened and publicly read at 10:00 A.M. on September 22nd, 2026 in the Board Room of the Monona County Board of Supervisors at Courthouse, 610 Iowa Ave, Annex Basement, Onawa, IA. Bids will be considered by the Monona County Board of Supervisors/Trustees acting for Oliver Lake Drainage District at that time or at a later meeting. The Board reserves the right to reject any and all bids and to waive informalities. Bid Security: Each bid must be accompanied by bid security as defined in Iowa Code Section 468.35, in an amount equal to five percent (5%) of the total amount of the Bid (including all alternates). Bid security shall be in the form of a cashier's check, certified check drawn on an FDIC insured bank in Iowa or the United States, certified share draft drawn on a credit union in Iowa or the United States, or a Bid Bond on the form provided in the Bidding Documents, executed by a corporation authorized to contract as a surety in Iowa. Bid security must be filed in a separate, sealed envelope attached to the bid proposal envelope. Iowa Contractor Registration and Bidder Status: All bidders must be registered with the Iowa Division of Labor Services prior to contract award (Iowa Code Chapter 91C). Bidders shall submit a completed State of Iowa Bidder Status Form with the bid proposal, per 875 Iowa Administrative Code Chapter 156. Failure to submit a fully completed Bidder Status Form may result in the bid being deemed non-responsive and rejected. Out-of-state bidders must comply with additional Iowa requirements. Preference of Products and Labor: Preference shall be given to domestic construction materials and Iowa products, provisions, and labor to the extent lawfully required under Iowa Code Chapters 73 and 73A. Resident bidder preference applies as per Iowa Code Chapter 73A. Sales Tax: The bidder shall not include Iowa sales tax in the bid. The Monona County Auditor will issue tax exemption certificates and authorization letters to the Contractor and qualifying subcontractors for the purchase of construction materials incorporated into this specific project. Time for Commencement and Completion of Work: Work on the improvement shall commence upon approval of the contract by the Board and issuance of a written Notice to Proceed. All work under the Contract must be Fully Completed (Final Completion) no later than September 24, 2027. Liquidated Damages: Liquidated damages in the amount of $500.00 per calendar day will be assessed for each day the work remains incomplete beyond the specified completion dates, subject to authorized extensions. Payment: Payment for work done will be made based on monthly estimates approved by the Engineer. Payments may be made in Drainage Warrants issued by the Drainage District. Registered warrants stamped "not paid for want of funds" shall bear interest at a rate fixed by the Board not to exceed the maximum set by law (Iowa Code Chapter 468). Progress payments will be made for ninety percent (90%) of the work completed, with ten percent (10%) retained per Iowa Code 468. Final payment and the release of retained funds will be made not less than thirty (30) days after completion and final acceptance of the work by the Board, subject to the conditions and procedures of Iowa Code Sections 468.100 through 468.103, including a final acceptance hearing. The Board reserves the right to issue Drainage District Improvement Certificates (Iowa Code Chapter 468). Performance, Payment, and Maintenance Bond: The successful bidder will be required to furnish a combined Performance, Payment, and Maintenance Bond in an amount equal to one hundred percent (100%) of the contract price. Said bond shall be issued by a responsible surety authorized to do business in Iowa and approved by the Board. The bond guarantees faithful performance, payment of labor and materials per Iowa Code Chapter 573, and maintenance of the improvements against defects in materials and workmanship for a period of one (1) year from the date of final acceptance.
