MONONA COUNTY BOARD OF SUPERVISORS MEETING APRIL 19, 2022 The Monona County Board of Supervisors met in regular session at 8:30 a.m. o'clock on Tuesday, April 19, 2022 in the boardroom of the courthouse in Onawa, Monona County, Iowa with Chairman Fox presiding. Other, Supervisors present: Tom Brouillette and Vince Phillips. Supervisor Absent: None. Also, present was Auditor Peggy A. Rolph. Motion was made by Supervisor Phillips, seconded by Supervisor Fox to approve the agenda. Vote on motion: All Ayes. Motion carried. Secondary Roads Engineer Dustin Wallis was present for Secondary Roads business Jackie Schrader was also present. Motion was made by Supervisor Phillips, seconded by Supervisor Brouillette to approve progress voucher #2 RC-C067(088)-9A-67. Vote on motion: All Ayes. Motion carried. Engineer Wallis updated the Board on the projects that the Inspectors are working on including closing out regular and FEMA projects. Scanning in bridge files, culvert files, ROW permits, and utility permits. Structure inspections for bridges under 20í township by township. Updating pipe book maps and spreadsheets for pipe information. Implemented new culvert repair/replacement reports for the Foremen to use and creating a new work order form to use in conjunction with the culvert inspections. Barge road project oversight inspection duties including tubes, backfill, and stripping. Engineer Wallis also updated the Board the projects he has been working on including setting up safety training for employees, coordinating rock hauling, Cedar Avenue easement, 220th culvert coordination. Opened Hemlock Bridge. Planning and coordinating two bridge rehab/repairs east of Moorhead. Discussed bridge/culvert inspection and projects with Foremen. Coordinating with Conservation on the Barge Road. Coordinate grader repair and E16 HMA project, trip permits, submitting DOT budget and plans. Discussion followed with no action taken. Present for the discussion on the use of County Vehicles were Joel Bubke, Keith Zediker, James R. Else DVM, Jackie Schrader, Abby Riesberg, Treasurer and Dustin Wallis, Engineer. Mr. Bubke expressed his concerns as a County Taxpayer who receives use of County Vehicles. Mr. Bubke was informed that the Engineer and Foremen take their County Vehicles home with them. If there are ongoing projects on the east side of the County the Assistants to the Engineer leave their County Vehicles parked at the Mapleton or Soldier sheds to save expenses and time. Mr. Bubke also asked what time the Assistants to the Engineer started work. Engineer Wallis informed Mr. Bubke it depends on the projects going on in the County; they are required to be on the jobsite to observe the work being done. A lengthy discussion followed with no action taken. The Construction Documents Project Manual for the Board of Supervisors Drainage Districts which expired on 12/31/2021 was reviewed and discussed. It was moved by Fox, seconded by Phillips, to not renew the Project Manual for 2022 due to engineering costs. They will handle the supervisor district repairs on a district by district basis. Motion by Fox, seconded by Phillips to establish the following policy: The Board of Supervisors of Monona County, Iowa, acting as Trustees for several Drainage Districts within Monona County here adopts the following policy regarding installation, maintenance and improvements to drainage structures which are located within District right-of-way and which serve as outlet structures for private drains. Landowners shall petition the District's Board of Trustees when desiring to install an outlet structure. Upon Board approval the Contractor for the District will install the structure in accordance with the recommendations of the District's Engineer with all costs for such work to be paid by the landowners. Following properly approved installation, the District will perform required maintenance of the structure including any necessary replacement. The cost of making improvements, such as changes in size, location or elevation of such structures, shall be paid by the person or persons requesting the improvements and the District shall in no way be obligated to make payment for such work. Improvements to such structures shall only be made as recommended and approved by the District's Engineer and placed by the Contractor for the District. As per Code Section 468.126.3 ñ ìWhen the board deems it necessary it may repair or reconstruct the outlet of any private tile line which empties into a drainage ditch of any district and assess the costs in each case against the land served by the private tile line. If the record establishes a structure that was installed by the District, then a new structure will be installed at no cost to landowners. If the structure is at the request of a landowner, the cost will be the landowners. If the structure is installed in an open field ditch, the cost will be the landowners. Chairman Fox and County Engineer Wallis were at the Maple River Lateral 1 site yesterday (4/18/2022) and ran GPS on the ROW marker locations staked by Sundquist Engineering. The majority of the markers were removed or put in remote locations where they would not affect farming operations. No permanent posts will be put in at this time. An estimate in the amount of $21,850. was received on April 18, 2022 from Albers Excavating and Hauling LLC for repair work on the Maple River Lateral 1 DD. An additional estimate of $3,500. was received on April 19, 2022 as a result of work added after additional inspection of the ditch by Fox. It was moved by Phillips, seconded by Fox to accept the total estimate in the amount of $25,350. and approve Albers Excavating and Hauling LLC to do the repair work as described in the estimate which will require final approval by the Board of Supervisors before the final 10% retainage fee will be paid. Vote on motion: Ayes: Fox, Phillips and Brouillette. Nays: None. Motion carried. It was moved by Fox, seconded by Brouillette to direct the drainage office to order a 12î x 60í corrugated pipe and bands from Glup Pipe Sales in Tekamah NE to be used on the Tim Struble repair with a total invoice amount of $1,159.40. Vote on motion: Ayes: Fox, Phillips and Brouillette. Nays: None. Motion carried. A flap gate will also be ordered through Glup Pipe Sales but will be the responsibility of the landowner for payment. In a phone conversation between Chairman Fox and Tim Struble on 4/14/2022, it was agreed to by Struble that it is the landownerís responsibility to cover the expense of the flap gate and any cost of connecting to the tile line. The district is responsible to supply and replace the existing tube. Chairman Fox talked to Struble on 4/19/2022. Struble will pick up and pay for the gate when it comes in. There has been a lot of discussion involving tile lines and responsibility for upkeep and maintenance. The supervisors will work on a policy to cover these concerns. An informational letter will be prepared and sent to the Maple River Lateral 1 Drainage District landowners to keep them advised and asking them to attend the May 3, 2022 Board of Supervisor's Meeting at 10:00 to discuss concerns and get their input on the upcoming repairs. Sandy Bubke, Zoning Administrator was present for the Zoning Commission's recommendation for the Floodplain Ordinance #67 and to set the public hearing date. Motion was made by Supervisor Fox, seconded by Supervisor Brouillette to acknowledge receipt of the Zoning Commission's recommendation for the Floodplain Ordinance #67. Vote on motion: All Ayes. Motion carried. Motion was made by Supervisor Fox, seconded by Supervisor Phillips to set the public hearing date for Ordinance #67 on May 10, 2022 at 11 a.m. Vote on motion: All Ayes. Motion carried. Sandy Bubke, Dustin Wallis, and Jeff Pratt were present for the discussion on the GPS tracking. It was determined that the current service that Verizon is offering will not detect rollovers. The County will be exploring other options that would detect rollovers. Discussion followed, no action taken. Sheriff Pratt was present for the approval of the Sheriff's Deputies training reimbursement agreement and Resolution 2022-14 Resolution Approving Reimbursement of Training Expenses Agreement Between Monona County Sheriff's Office and Sheriff's Deputies also present was Engineer Wallis. Motion was made by Supervisor Brouillette, seconded by Supervisor Phillips to approve the Sheriff's Deputies training reimbursement agreement. Vote on motion: All Ayes. Motion carried. Supervisor Fox introduced and moved for adoption the following Resolution, seconded by Supervisor Phillips: RESOLUTION 2022-14 RESOLUTION APPROVING REIMBURSEMENT OF TRAINING EXPENSES AGREEMENT BETWEEN MONONA COUNTY SHERIFF'S OFFICE AND SHERIFF'S DEPUTIES WHEREAS, the Board of Supervisors of Monona County are desirous that all sheriff's deputies receive peace officer certification from the Iowa Law Enforcement Academy required by Iowa; and WHEREAS, the Supervisors have determined to pay for the wages and expenses of the training for certification for candidates which require certification when they are hired as deputies by the County; and WHEREAS, it is fiscally responsible and necessary to the public good for the County to be reimbursed for all certification expenses and wages paid on behalf of uncertified Monona County deputies if they resign from County employment prior to four (4) years after receiving certification; and THEREFORE, BE IT RESOLVED BY THE MONONA COUNTY BOARD OF SUPERVISORS, that all candidates for employment as sheriffís deputies shall be required to execute an Agreement entitled ìREIMBURSEMENT OF TRAINING EXPENSESî and containing the requirements for reimbursement of wages and expenses; AND ITI IS FURTHER RESOLVED, that the Sheriff is authorized to execute such Agreement for Reimbursement on behalf of Monona County, Iowa Passed and approved this 19 day of April 2022.
