MONONA COUNTY BOARD OF SUPERVISORS MEETING OCTOBER 10, 2023 The Monona County Board of Supervisors met in regular session at 8:30 a.m. o’clock on Tuesday, October 10, 2023 in the boardroom of the courthouse in Onawa, Monona County, Iowa with Chairman Fox presiding. Other, Supervisors present: Tom Brouillette and Vince Phillips. Supervisor Absent: None. Also, present was Auditor Peggy A. Rolph. Motion was made by Supervisor Phillips, seconded by Supervisor Fox to approve the agenda. Vote on motion: Ayes: Fox, Brouillette, and Phillips. Nays: None. Motion carried. Present for the discussion on the phone issues were Jim Wigton, IT Director and Cassie Faith, Assessorís Project Manager. Cassie stated that the Assessorís office is having issues with vendors getting through to their office; other complaints were also brought up. The Supervisors asked Jim to check into another phone carrier and report back to the Board. No action taken. Secondary Roads Office Manager Deleta Huffman and Secondary Roads Maintenance Superintendent Shawn Bellis were present for Secondary Roads business. Present for discussion on vacated roads were Cassie Faith, Assessor’s Project Manager and Ian McConeghey, County Attorney. Everyone agreed that Monona County needs a policy on what happens after a road is vacated. The Field Technician job description was discussed and was decided more clarification was needed, before the internal posting could take place. No action taken. The Secondary Roads Maintenance Superintendent three-month evaluation was done, no action taken. The Monona County Board of Supervisors, acting as Trustees of the Onawa Drainage District, met on Tuesday, October 10, 2023 at 10:00 a.m. in the Basement Conference Room of the Courthouse in Onawa, Monona County, Iowa. Supervisors present: Fox, Phillips and Brouillette. Absent: None. Also present Patrick Mouw, Engineer, Gary Taylor, District Attorney, Bryan Phillips, Drainage Clerk, Amy Borchardt-Sick, Drainage Clerk and Peggy Rolph, Auditor. Others present: Paul and Joleene Duff, Rose MacClure, Kevin and Doreen Heisterkamp. At 10:30AM, Chairman Fox motioned, seconded by Phillips to open the public hearing on the Right-Of-Way permanent easement assessment and valuation in the Onawa Drainage District, Monona County, Iowa. Vote on motion: Ayes: Fox, Phillips and Brouillette. Nays: None. Motion carried. The Drainage Clerk announced no written objections had been filed prior to the time of the hearing. Engineer Mouw, as spokesman for the Board of Trustees, explained the reason for purchase of a permanent easement approximately one (1) block south of Maple Street between 10th and 11th Street and stated the classification of said land was comparable with adjoining land. Paul Duff expressed concerns about a few trees and a well lying inside the easement. Engineer Mouw stated the boring of the pipe will not be a concern for the trees, but would like to examine the exact location of the well as one-call does not locate private pumps or utilities. Kevin and Doreen Heisterkamp expressed concerns about putting up a fence along their property within the easement and adding a driveway to the end of 11th street. Engineer Mouw stated a fence would be fine to install, but if maintenance were to be done, the fence would be removed and replaced at owner’s expense. The driveway can be added as long as they match the pavement of 11th street. After hearing all comments and concerns, it was moved by Fox, seconded by Brouillette at 11:15AM that the hearing be closed. Vote on motion: Ayes: Fox, Phillips and Brouillette. Nays: None. Motion carried. After full consideration of matters pertaining to this hearing and the Board being duly advised in the premises, Chairman Fox introduced, caused to be read and moved the adoption of the following: RESOLUTION WHEREAS, the Monona County Board of Supervisors, acting as Trustees for the Onawa Drainage District, heretofore appointed Patrick E. Mouw, Engineer, and Joel Bubke and Zack Goslar as Commissioners to classify the lands in said District; and WHEREAS, said Engineer and Commissioners duly qualified and made a Report which was filed with the Monona County Drainage Clerk and the Drainage Clerk gave due notice thereof to the affected owners of land within said District, said notice showing the names of the owners of land and the percentage of benefits of each tract of land, which notice was published in the Onawa Democrat on the 20th day of September, 2023; and proof of publication is on file in the Monona County Drainage Office; and WHEREAS, said Board, at the time fixed for hearing in said notice, has fully considered the report and has been duly advised in the premises. NOW, THEREFORE, BE IT RESOLVED by the Monona County Supervisors, acting as Trustees of the Onawa Drainage District, as follows: 1. That the Report of the Engineer on Right-Of-Way permanent easement and valuation of land filed on August 4, 2023 is hereby approved, confirmed and adopted as being correct, just and equitable. 2. That the assessments levied upon the lands shall be limited to a proportionate share of the costs of current and future maintenance, repairs and improvements. BE IT FURTHER RESOLVED that the Report of the Commissioners shall constitute a classification of the lands involved and shall remain the basis of all further assessments for the purpose of said District unless revised by the Board in the manner provided for reclassification. /s/ Bo Fox CHAIRMAN ATTEST: /s/ Bryan Phillips DRAINAGE CLERK Supervisor Phillips seconded the motion to adopt the foregoing Resolution, and upon roll being called, the vote was as follows: AYES: Fox, Phillips and Brouillette. NAYS: None. Whereupon, the Chairman of the Board declared the motion carried and the Resolution duly adopted. Jackie Wessel was present for the opening of bids for the County owned properties parcel numbers BLWM 8245-09-1-75-001, CSMV 8444-24-4-007, and MTMV 8543-24-1-25-002. Supervisor Fox opened the bid for MTMV 8543-24-4-00-007 from Monona County Mechanical for $650. There were no other bids on the other County owned parcels. Motion was made by Supervisor Phillips, seconded by Supervisor Brouillette to sell parcel MTMV 8543-24-1-25-002 to the highest bidder Monona County Mechanical for $650.00. Vote on motion: Ayes: Fox, Brouillette, and Phillips. Nays: None. Motion carried. The Supervisors held the interview for the Building Maintenance/Grounds Position. No action was taken. Motion was made by Supervisor Phillips, seconded by Supervisor Brouillette to approve the minutes of October 3, 2023 as read. Vote on motion: Ayes: Fox, Brouillette, and Phillips. Nays: None. Supervisor Fox attended the Monona County Conservation Board Meeting, he shared the information presented. Motion was made by Supervisor Phillips, seconded by Supervisor Fox to re-appoint Ryan Clark and Kirk Rose to the Landfill Commission. Vote on motion: Ayes: Fox, Brouillette, and Phillips. Nays: None. Motion carried. Motion was made by Supervisor Fox, seconded by Supervisor Brouillette to appoint Kevin Ewing, Sheriff and Jim Wigton, IT Director to the HIPAA Committee. Vote on motion: Ayes: Fox, Brouillette, and Phillips. Nays: None. Motion carried. Motion was made by Supervisor Fox, seconded by Supervisor Brouillette to approve General Ledger Journal Entry for Secondary Roads to correct the incorrect date on a claim. Vote on motion: Ayes: Fox, Brouillette, and Phillips. Nays: None. Motion carried. Motion was made by Supervisor Brouillette, seconded by Supervisor Fox to approve the bid from Woodhouse Chevrolet to purchase a 2023 Chevy Travers LT. Vote on motion: Ayes: Fox, Brouillette and Phillips. Nays: None. Motion carried. Motion was made by Supervisor Phillips, seconded by Supervisor Brouillette to acknowledge receipt of Monona County Zoning/Environmental Health quarterly report FY 2024 July-September 2023. Vote on motion: Ayes: Fox, Brouillette and Phillips. Nays: None. Motion carried. Motion was made by Supervisor Fox, seconded by Supervisor Phillips to acknowledge receipt of the Sheriff’s Report of Fees collected for September 2023. Vote on motion: Ayes: Fox, Brouillette and Phillips. Nays: None. Motion carried. TITLE VI Present for the Title IV discussion were Abby Riesberg, Treasurer; Shawn Bellis, Secondary Roads Maintenance Superintendent; Deleta Huffman, Secondary Roads Office Manager; and Ian McConeghey, County Attorney. Abby has been working with the various departments to get the Title VI report completed and sent to Tracey Bradley, Affirmative Action Compliance Officer, Civil Rights Bureau. Motion was made by Supervisor Phillips, seconded by Supervisor Brouillette to authorize the Chairman’s signature on the Title VI documents. Vote on motion: Ayes: Fox, Brouillette, and Phillips.
