MONONA COUNTY BOARD OF SUPERVISORS MEETING MAY 31, 2022 The Monona County Board of Supervisors met in regular session at 8:30 a.m. o’clock on Tuesday, May 31, 2022 in the boardroom of the courthouse in Onawa, Monona County, Iowa with Chairman Fox presiding. Other, Supervisors present: Tom Brouillette and Vince Phillips. Supervisor Absent: None. Also, present was Auditor Peggy A. Rolph. Motion was made by Supervisor Fox, seconded by Supervisor Brouillette to approve the agenda. Vote on motion: All Ayes. Motion carried. Present for the Covid-19 Burgess Public Health update were Adam Hadden via phone. There were sixteen cases in the month of May, 48 deaths, and the total vaccination rate for the county is 54.1%. Vaccinations have slowed down. Family Medicine Clinic and Burgess Family Clinics (Mapleton, Sloan, and Whiting) are providing the vaccines. Discussion followed no action was needed. Present along with the Supervisors and Auditor for the Elected Official / Director Meeting were Patrick Prorok, EMA Director; Abby Riesberg, Treasurer; Kelly Seward, Recorder; Jeff Pratt, Sheriff; Sharon Gries, Chief Deputy Assessor; Dustin Wallis, Engineer; Doug Kuhlmann, Conservation Director; and Sandy Bubke, Zoning and Environmental Health Administrator. Absent were Don Thompson, Veteran Affairs Director and Ian McConeghey, County Attorney. Activities were discussed and information was shared. Secondary Roads Engineer Dustin Wallis was present for Secondary Roads business. Discussion items were maintainers on the roads and rock hauling, No action taken. The joint boards of Harrison and Monona Counties discussed several concerns in regards to a McNeill Main Cleanout which included railroad culverts and cost of cleanout. ISG Engineer, Ivan Droessler, was available via phone, to clarify some questions, as well as, explain the timeline if this project was approved. The project would be done in (2) phases. Phase 1 beginning in Harrison County with excavation up to the first railroad crossing which is 8.3 miles up from the outlet. We would have to go through the public hearing process, final plans and bidding to do Phase 1 and immediately start the discussion process with the railroad company regarding their culverts right after the public hearing on the Engineerís Report and would be looking for them to address their culverts over the next two years. The district would be ready to initiate Phase II in cleaning out from the railroad crossings up stream after they have lowered their crossings. There was discussion regarding culvert capacity at the outlet of the McNeill into the Monona Harrison. The trustees agreed that Droessler should revisit this issue. 1955 and 1994 were the last times the ditch had any cleanout done per Droessler and they were not full cleanouts. Annexation and Reclassification were discussed. An Engineer’s Report was completed in June 2013 for Repairs/Cleanout on the McNeill Inter-County Drainage District. This Engineerís Report is good for ten years. After discussion between the joint boards, the following action was taken: It was moved by Fox, seconded by Phillips to appoint ISG as Engineer for the McNeill Drainage District and direct ISG to update the quantities of the 2013 Engineerís Report. Vote on motion: Ayes: Fox, Brouillette, Phillips, Smith, Straight and Utman. Nays: None. Motion Carried. It is moved by Brouillette, seconded by Phillips to set July 12th, 2022 @ 10:00 a.m. for public hearing on the 2013 Engineerís Report with the updated quantities. Location of the hearing will be the Onawa Public Library, 707 Iowa Avenue, Onawa IA 51040. Vote on motion: Ayes: Fox, Brouillette, Phillips, Smith, Straight and Utman. Nays: None. Motion carried. It is moved by Phillips, seconded by Utman to appoint Gary Taylor as legal counsel to represent the McNeill Drainage District for the hearing process. Vote on motion: Ayes: Fox, Brouillette, Phillips, Smith, Straight and Utman. Nays: None. Motion carried. Supervisor Fox moved to call the Public Hearing on proposal to incur non-current debt in an amount not to exceed $500,000 to order at 11:00 a.m. in the Boardroom of the Courthouse, seconded by Supervisor Brouillette. Vote on motion: All Ayes. Motion carried. The County Auditor announced that no written objections had been placed on file. Whereupon, the Chairman called for any written or oral objections, and here being none, it was moved by Supervisor Phillips at 11:20 a.m. to close the Public Hearing, seconded by Supervisor Brouillette. Vote on motion: All Ayes. Motion carried. Supervisor Fox introduced and moved for adoption the following Resolution, seconded by Supervisor Phillips: RESOLUTION 2022-20 RESOLUTION AUTHORIZING INTERNAL ADVANCE TO FUND URBAN RENEWAL PROJECT COSTS WHEREAS, the Board of Supervisors of Monona County, Iowa (the ‘County’), has established the Monona County Urban Renewal Area (the ‘Urban Renewal Area’) and has established the Monona County Urban Renewal Area Tax Increment Revenue Fund (the ìTax Increment Fund) in connection therewith; and WHEREAS, the County has undertaken a certain urban renewal project in the Urban Renewal Area consisting of constructing the County Highway E60 Improvements Project (the ‘Project’); and WHEREAS, it has been proposed that the County facilitate an internal advance of funds in the amount of $500,000 (the ìAdvanceî) for the purpose of financing a portion of the costs of the Project, and, pursuant to Section 331.479 of the Code of Iowa, the County has published notice and has held a public hearing on such proposal on May 31, 2022, and WHEREAS, the County desires to make the Advance eligible to be repaid from future incremental property tax revenues to be derived from the Urban Renewal Area; NOW, THEREFORE, IT IS RESOLVED by the Board of Supervisors, as follows: Section 1. It is hereby directed that the Advance in the amount of Five Hundred Thousand Dollars ($500,000) be advanced from the Secondary Roads Fund (the ìSource Fundî) in order to finance a portion of the costs of the Project. The Advance shall be repaid to the Source Fund, without interest, out of incremental property tax revenues received with respect to the Urban Renewal Area. It is intended that the Advance shall be repaid to the Source Fund in one or more annual installments on or before June 1, 2030, provided however that repayment of the Advance is subject to the determination of the Board of Supervisors that there are incremental property tax revenues available for such purpose which have been allocated to or accrued in the Tax Increment Fund relative to the Advance, and the Board of Supervisors reserves the right to appropriate funds, or to withhold such appropriation, at its discretion. All payments made will be applied first to accrued interest and then to the Advance. Section 2. A copy of this Resolution shall be filed in the office of the County Auditor to evidence the Advance. Pursuant to Section†403.19 of the Code of Iowa, the County Auditor is hereby directed to certify, no later than December†1, 2022, the original amount of the Advance. Section 3. All resolutions or parts thereof in conflict herewith, are hereby repealed, to the extent of such conflict. PASSED AND APPROVED this 31st day of May, 2022. Motion carried. Motion was made by Supervisor Brouillette, seconded by Supervisor Fox to acknowledge receipt of West Central Community Action Annual Report for 2021. Vote on motion: All Ayes. Motion carried. Motion was made by Supervisor Phillips, seconded by Supervisor Fox to acknowledge receipt of letter from Red Barn Veterinary Clinic recommending Officer Jenjo be retired from service. Vote on motion: All Ayes. Motion carried. Compensation for mileage was discussed, no action taken. Motion was made by Supervisor Fox, seconded be Supervisor Brouillette to approve the Sheriff’s Deputy amended contact. Vote on motion: All Ayes. Motion carried. Motion was made by Supervisor Fox, seconded by Supervisor Phillips to acknowledge receipt of proposed Amendment No. 9 to the Onawa Urban Renewal Plan in the City of Onawa, State of Iowa.
