MONONA COUNTY BOARD OF SUPERVISORS MEETING JANUARY 3, 2023 The Monona County Board of Supervisors met in regular session at 8:30 a.m. oíclock on Tuesday, January 3, 2023 in the boardroom of the courthouse in Onawa, Monona County, Iowa with Chairman Fox presiding. Other, Supervisors present: Tom Brouillette and Vince Phillips. Supervisor Absent: None. Also, present was Auditor Peggy A. Rolph. Motion was made by Supervisor Phillips, seconded by Supervisor Fox to approve the agenda. Vote on motion: All Ayes. Motion carried. Motion was made by Supervisor Phillips, seconded by Supervisor Brouillette to elect Supervisor Fox as the Chairperson and Supervisor Brouillette as Vice-Chairperson. Vote on motion: All Ayes. Motion carried. Present for the Elected Officials oath of offices were Craig Riesberg, Charlie Riesberg, Henry Riesberg and Paula Corzette, Recorder Deputy. Supervisor Fox swore in the newly elected officials. Officials were: Ian McConeghey, Monona County Attorney; Kelly K. Seward, Monona County Recorder; Tom Brouillette, Monona County Supervisor District Two; Vincent Phillips, Monona County Supervisor District Three and Abby Riesberg, Monona County Treasurer. Randy Ping, Part-Time Temporary Custodian was present via phone for an update. Randy updated the Board on the status of the furnace install in the courthouse basement. Discussion followed with no action needed. Dustin Wallis, Engineer was present for the discussion on the printer usage between the Secondary Roads office and the Zoning office. Motion was made by Supervisor Fox, seconded by Supervisor Brouillette instructing Engineer Wallis that Secondary Roads is to share the printer/copier with Zoning as it was previously done. Vote on motion: All Ayes. Motion carried. Secondary Roads Engineer Dustin Wallis was present for Secondary Roads business Kelly Parsley, Deputy Auditor was also present. The hours worked by Secondary Roads on Saturday 12/24/2022 were discussed. Since Friday, December 23, 2022 was a day off given by the Board of Supervisors and classified as miscellaneous hours they are not counted as hours worked. Therefore, the hours on Saturday are not considered time and a half. Motion was made by Supervisor Fox, seconded by Supervisor Phillips to pay the Secondary Roads employees that worked on Saturday December 24, 2022 as straight time. Vote on motion: All Ayes. SR 23-01 Be it resolved by the Board of Supervisors of Monona County, Iowa, that Dustin J. Wallis, P.E., the County Engineer of Monona County, Iowa, be and is hereby designated, authorized and empowered on behalf of the Board of Supervisors of said County to execute certification of completion of work and final acceptance thereof in accordance with plans and specifications therefore in connection with all Farm to Market and Federal or State aid construction projects in this county. SR 23-02 Whereas, Section 306.41 of the Code of Iowa, 1992, provides that: The agency having jurisdiction and control over any highway in the state, or the chief engineer of said agency when delegated by such agency, may temporarily close sections of a highway by formal resolution entered upon the minutes of such agency when reasonably necessary because of construction, reconstruction, maintenance or natural disaster and shall cause to be erected ìroad closedî signs and partial or total barricades in the roadway at each end of the closed highway section and on the closed highway where that highway is intersected by other highways if such intersection remains open. Any numbered road closed for over fortyñeight hours shall have a designated detour route. The agency having jurisdiction over a section of highway closed in accordance with the provisions of this section, or the persons or contractors employed to carry out the construction, reconstruction, or maintenance of the closed section of highway, shall not be liable for any damages to any vehicle that enters the closed section of highway or the contents of such vehicle or for any injuries to any person that enters the closed section of highway, unless the damages are caused by gross negligence of the agency or the contractor. Nothing herein shall be construed to prohibit or deny any person from gaining lawful access to the personís property or residence, nor shall it change or limit liability to such persons. Now therefore be it resolved by the Board of Supervisors of Monona County, Iowa, that Dustin J. Wallis, P.E., the County Engineer be authorized to close Monona County Secondary Roads as necessary with the actual dates of closure to be determined by the County Engineer, as follows: For Construction: Any project as described in the approved Monona County Secondary Road Construction Program or any approved supplements thereto in the calendar year of 2023; For Emergency Closure of Any Road for Maintenance Purposes; Any route deemed necessary by the County Engineer. If closure is to be for an extended time, it will be resolved by resolution at the next meeting of the Board of Supervisors. For Closure of Any Road for a special Event; Any route requested by a recognized sponsor or public entity for an event that the public is invited to attend. All road closures will be designated with signs in accordance with the Manual of Uniform Traffic Control Devices. SR 23-06 Be it resolved by the Board of Supervisors of Monona County, Iowa, that the following rates be set for payment of fence removal and replacement to the property owners, on construction projects: Removal: $9.10/rod Woven fence: $22.80/rod Barbed fence: $18.45/rod Electric fence: $13.20/rod Corner Posts: $66.00/each These prices reflect the prices as quoted by a local contractor for the removal and reinstallation of the existing fencing material. These prices will remain in effect until further notice. SR 23-07 The Board of Supervisors establishes the crop damage payment for loss of crop due to secondary road construction activities. $550.00 per acre for soybeans or $850.00 per acre for corn. These prices will remain in effect until further notice. Rolph Monona County Auditor Discussion items were rock and tree cutting, no action was needed. Present for the Covid-19 Burgess Public Health update were Patrick Prorok and Adam Hadden Burgess Public Health via phone. There were 37 cases in the month of December and a total of 53 deaths. Monona County is in a low transmission rate. Patrick stated that there is a lot of influenza and RSV going around, discussion followed no action was taken. Motion by Fox, seconded by Brouillette, to establish the following policy for 2023: That the Drainage Districts, under the supervision of the Monona County Board of Supervisors, warrants unpaid for lack of funds shall bear interest at the rate of five percent (5%) per annum unless otherwise authorized by the Board Designate the Onawa Democrat and the Mapleton Press as the official newspaper of the Supervisor Drainage Districts Authorize the Monona County Treasurer to investigate the best interest rates and invest the excess funds and income of the Supervisor Drainage Districts, pending board approval That $100.00 for each beaver trapped on the Drainage Districts, under the supervision of the Monona County Board of Supervisors, be paid to those parties with permits and subject to the conditions of the permit That the Notice on Dumping Foreign Material in Rivers and Streams be published in the designated official newspapers for one week the month of March That Supervisor Brouillette be appointed as delegate and Supervisor Fox be appointed as alternate to the Iowa Drainage District Association for 2023. Vote on motion: AYES: Brouillette, Fox and Phillips. NAYS: None. Three copies of the contract provided by Johnston Excavating, LLC, for the Gray DD Lateral B Cleanout project were signed by Chairman Fox of which one copy will be placed on file along with the Performance, Payment and Maintenance Bond provided by Johnston Excavating, LLC and its surety, Lexington National Insurance Corporation, one copy of the signed Notice of Award, and a copy of their Certificate of Insurance for the project. Due to the weather Jim Wigton, IT Director was not in attendance for the meeting. Motion was made by Supervisor Phillips, seconded by Supervisor Brouillette to table Jim Wigton, IT Director work from home, firewall-VPN, panic buttons, door access for courthouse door, remote temperature sensors. Vote on motion: All Ayes. Motion carried. Ian McConeghey, County Attorney was present to discuss the William Wood Contract for the food pantry in Mapleton. It was discovered that Monona County has been paying rent on two lots and only using one of them for the food pantry. Motion was made by Supervisor Phillips, seconded by Supervisor Brouillette to update the contract for lot 8 block 2 in Mapleton, Iowa to be sent to William Wood for signature. Vote on motion: All Ayes. Motion carried. Present along with the Supervisors and Auditor for the Compensation Board Recommendations were Ian McConeghey, County Attorney; Abby Riesberg, Treasurer; Kelly Seward, Recorder and Jeff Pratt, Sherriff. The Compensation Board Recommendations were discussed. Motion was made by Supervisor Fox, seconded by Supervisor Brouillette to acknowledge receipt of the Monona County Compensation Board Recommendations. Vote on motion: All Ayes. Motion carried. Motion was made by Supervisor Phillips, seconded by Supervisor Fox to approve the Compensation Board Recommendations as presented. A 7% increase for the Sheriff and County Attorney, an 8% increase for the Auditor, Recorder, and Treasurer. Vote on motion: All Ayes. Motion carried. Ian McConeghey, County Attorney was present to discuss reconsidering the authorization to hire an Assistant County Attorney. Ian had not presented a contract or wage change form to the Supervisors upon getting authorization to hire. He presented the Supervisors with a contract for the Assistant County Attorney discussion followed. Motion was made by Supervisor Fox, seconded by Supervisor Brouillette to approve the contract for the Assistant County Attorney; starting wage will be $40,446 per year and not to exceed 29 hours per week. Supervisor Fox introduced and moved to adopt the following Resolution, seconded by Supervisor Phillips RESOLUTION 2023-01 CONSTRUCTION EVALUATION RESOLUTION WHEREAS, Iowa Code section 459.304(3) sets out the procedure if a Board of Supervisors wishes to adopt a ìconstruction evaluation resolutionî relating to the construction of a confinement feeding operation structure; and WHEREAS, only counties that have adopted a construction evaluation resolution can submit to the Department of Natural Resources (DNR) an adopted recommendation to approve or disapprove a construction permit application regarding a proposed confinement feeding operation structure; and WHEREAS, only counties that have adopted a construction evaluation resolution and submitted an adopted recommendation may contest the DNRís decision regarding a specific application; and WHEREAS, by adopting a construction evaluation resolution the Board of Supervisors agrees to evaluate every construction permit application for a proposed confinement feeding operation structure received by the Board of Supervisors between February 1, 2023 and January 31, 2024 and submit an adopted recommendation regarding that application to the DNR; and WHEREAS, the Board of Supervisors must conduct an evaluation of every construction permit application using the master matrix created in Iowa Code section 459.305, but the Boardís recommendation to the DNR may be based on the final score on the master matrix or may be based on reasons other than the final score on the master matrix; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF MONONA COUNTY that the Board of Supervisors hereby adopts this construction evaluation resolution pursuant to Iowa Code section 459.304(3).
