MONONA COUNTY BOARD OF SUPERVISORS MEETING AUGUST 9, 2022 The Monona County Board of Supervisors met in regular session at 8:30 a.m. o’clock on Tuesday, August 9, 2022 in the boardroom of the courthouse in Onawa, Monona County, Iowa with Chairman Fox presiding. Other, Supervisors present: Tom Brouillette and Vince Phillips. Supervisor Absent: None. Also, present was Auditor Peggy A. Rolph. Motion was made by Supervisor Fox, seconded by Supervisor Phillips to approve the agenda. Vote on motion: All Ayes. Motion carried. Secondary Roads Engineer Dustin Wallis was present for Secondary Roads business. Present for the discussion on Cedar Avenue were Philip Jorgenson, Joel Vos, Gary Taylor, Assistant County Attorney. Gary stated that there is no question that Monona County has legal title to the portion of Cedar Avenue in question. The fact that the road has existed in its present location for more than 130 years means that Monona County would have acquired legal title by adverse possession about 120 years ago. Discussion followed. Motion was made by Supervisor Phillips, seconded by Supervisor Brouillette to authorize Gary Taylor, Assistant County Attorney send a letter to the property owners regarding Cedar Avenue. Vote on motion: All Ayes. Motion carried. Motion was made by Supervisor Fox, seconded by Supervisor Phillips to approve miscellaneous utility permit for Western Iowa Power Cooperative for a single phase underground cable being installed across Peach Avenue from existing single phase underground cable being installed across Peach Avenue from existing single phase pole on the west side of Peach Avenue going east to right of way edge. Road crossing will be 2580 feet north of the intersection of Peach Avenue and 260th on Peach Avenue in Jordan Township. Vote on motion: All Ayes. Motion carried. Sandy Bubke, Zoning Administrator was present for discussion county policies and procedures on building permits and roads. A lengthy discussion followed, no action was taken. Tony Mahlberg was present to discuss leave time. Tony pointed what he feels are discrepancies in the Union Contract. A lengthy discussion followed, no action was taken. Present at 10:00 a.m. was John Torbert, Iowa Drainage District Association Executive Director. Mr. Torbert was present to update the Board on the activities and concerns of the Iowa Drainage District Association. John reported on Waters of the United States pertaining to the EPAís regulating of waters. No final ruling has been released. Some discussion on Senate Bill 500 which IDDA is opposed to. The bill did not make it through but may be back next year. The IDDA annual meeting is scheduled for December 2, 2022 in Fort Dodge. After some questions and discussion with the Supervisors, the Board, on its own motion and vote, duly carried, adjourned. Deputy Robert Maule, K-9 Officer Jenyo, Sgt. Jeremy Bellis, and Sheriff Pratt were present for approval to retire K-9 Officer Jenyo. Motion was made by Supervisor Fox, seconded by Supervisor Phillips to approve retirement of K-9 Officer Jenyo. Vote on motion: All Ayes. Motion carried. John Danos, Dorsey & Whitney was present via phone for questions on the TIF rebate program. Discussion followed with no action taken. Motion was made by Supervisor Phillips, seconded by Supervisor Fox to approve the minutes of August 2, 2022 as read. Vote on motion: All Ayes. Motion Carried. Motion was made by Supervisor Fox, seconded by Supervisor Brouillette to approve claims. Vote on motion: All Ayes. Motion Carried. Motion was made by Supervisor Fox, seconded by Supervisor Brouillette to acknowledge receipt of Manure Management Annual Update for Ernst Lyle facility #57963. Vote on motion: All Ayes. Motion carried. Motion was made by Supervisor Fox, seconded by Supervisor Phillips to acknowledge receipt of letter from Iowa Firearms Coalition. Vote on motion: All Ayes. Motion carried Motion was made by Supervisor Brouillette, seconded by Supervisor Fox to acknowledge receipt of Manure Management Annual update for Ryan Paulsen facility #59952. Vote on motion: All Ayes. Motion carried. Motion was made by Supervisor Fox, seconded by Supervisor Brouillette to recess at 11:40 a.m. Vote on motion: All Ayes. Motion carried. It was moved by Supervisor Phillips to reconvene at 1 p.m., seconded by Supervisor Fox. Vote on motion: All Ayes. Motion carried. The Supervisors along with Micah Van Maanen, Sioux County IT Director performed the interviews for the open IT position. Discussion followed with no action taken. It was moved by Supervisor Fox, seconded by Supervisor Brouillette to hereby adjourn at the hour of 3:00 p.m. o’clock. Vote on motion: All Ayes.
