MINUTES OF THE CITY OF CHARTER OAK, IOWA The meeting was called to order by Randy Ulmer, Mayor, and on roll call the following council members were present: Opened hearing at 7:03 PM PRESENT: Russ Maack, Jim Wilcox. Alec Castillo ABSENT: Peggy Staley, Ben Heyne The purpose of the meeting was to hold a public hearing on the proposal to vacate a street and alley in Block Five in North Charter Oak, Crawford County, lowa. Interested individuals attending the public hearing are as follows: Kelley Kuhlmann The City council was informed that the proponents of the vacation of the street only wanted the portion of the street abutting their property to be vacated, not the entire street. The Ordinance vacating the street will be the South part of the street. There being no objections and no further discussions it was moved by member Maack and seconded by council member Wilcox to close the public hearing. AYES: Russ Maack, Jim Wilcox, Alec Castillo NAYS: None ABSENT: Peggy Staley, Ben Heyne The Mayor declared that the public hearing was closed at 7:04PM. ORDINANCE NO. 193-22 "AN ORDINANCE VACATING ALL THAT PART OF AN EIGHTY FOOT (80') PUBLIC STREET (N. SPRUCE AVE) COMMENCING AT THE NORTHEAST CORNER OF LOT FOUR (4) IN BLOCK FIVE (5) IN NORTH CHARTER OAK; THENCE SOUTH ALONG THE EAST BOUNDARY LINE OF LOTS FOUR (4), FIVE (5) AND SIX (6) IN BLOCK FIVE (5) NORTH CHARTER OAK TO THE SOUTHEAST CORNER OF LOT SIX (6) IN BLOCK FIVE (5) IN NORTH CHARTER OAK, CRAWFORD COUNTY, IOWA. AND ALL THAT PART OF A SIXTEEN FOOT (16) PUBLIC ALLEY LOCATED BETWEEN THE SOUTH BOUNDARY LINE OF FIFTH STREET NORTH AND THE NORTH BOUNDARY LINE OF FOURTH STREET NORTH, ALL LYING ADJACENT AND ABUTTING LOTS 1, 2, 3, 4, 5, 6, 7,8,9,10,11, AND 12 IN BLOCK FIVE IN NORTH CHARTER OAK, CRAWFORD COUNTY, IOWA." BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHARTER OAK, IOWA, AS FOLLOWS: Section 1. That all that part of an Eighty Foot (80) public street (N. Spruce Ave.) Commencing at the Northeast corner of Lot Four (4) in Block Five (5) in North Charter Oak; thence South along the East boundary line of Lots Four (4), Five (5) and Six (6) in Block Five (5) North Charter Oak to the Southeast corner of Lot Six (6) in Block Five (5) in North Charter Oak, Crawford County, Iowa. And All that part of a Sixteen Foot (16) public alley located between the South boundary line of Fifth Street North and the North boundary line of Fourth Street North, all lying adjacent and abutting Lots 1, 2, 3, 4, 5, 6, 7,8,9,10,11, and 12 in Block Five in North Charter Oak, Crawford County, Iowa, be and the same is hereby vacated. Section 2. That all ordinances and parts of ordinances in conflict with this ordinance are hereby repealed. Section 3. This ordinance shall be in full force and effect on and after its final passage and publication as provided by law.
