City of Ute REGULAR COUNCIL MEETING October 3, 2022 The Ute City Council met with Mayor Richard Hageman in regular, open session on October 3, 2022 at 7:00 p.m. Council members present: Becky Miller, Ryan Pithan, Jimmy Carlson, and Matt Leitz. Absent: Ciera Carlson. Also present: Lonnie Carlson. Motion by JCarlson/Leitz to approve the agenda. All ayes. MC Sandy Bubke discussed running for Monona County Supervisor. She has worked with the county for 19 years and is running against Tom Brouillette. Building Permits Approved: Chris Hunter – roof over patio. Lonnie stated that Colt from M & E Plastic Repair had stopped to look at the playground equipment at the park and received a bid of $5,000.00 to repair all slides, handrails, mounting points, and remove graffiti with work guaranteed for 3 years. Motion by JCarlson/Miller to accept the bid and hire M & E Plastic Repair’s bid for $5,000.00. All ayes. Clean up of property located at 203 S Day Avenue was discussed. Motion by Pithan/JCarlson to approve the consent agenda: Approval of Minutes for September 6, 2022 Meeting Approval of August 2022 bills Approval of September 2022 bills All Ayes. Motion carried. The development agreement with Kyle and Christy Schultz for the lots on Main Street was discussed. Minimum improvements to be completed within 1 year: site grading, connections to city water and sewer systems, and foundation poured. Clerk will forward to city attorney for review. Motion by Pithan/Miller to approve the 1st reading of ORDINANCE 225 – AN ORDINANCE AMENDING THE CITY OF UTE, IOWA MUNICIPAL CODE 2017, BY MODIFING SECTION 3-3-69 OPERATION OF GOLF CARTS. Ayes: Miller, JCarlson, Leitz, Pithan. Absent: CCarlson. Motion carried. Motion by JCarlson/Leitz to waive the 2nd and 3rd readings and adopt ORDINANCE 225 – AN ORDINANCE AMENDING THE CITY OF UTE, IOWA MUNICIPAL CODE 2017, BY MODIFING SECTION 3-3-69 OPERATION OF GOLF CARTS. Ayes: Miller, JCarlson, Leitz, Pithan. Absent: CCarlson. Motion carried. Motion by Miller/Pithan approve Legal Services Agreement with Crary, Huff, Ringgenberg, Hartnett & Storm, P.C. All ayes. MC Not to exceed $951,000 Water Revenue Capital Loan Notes Resolution 2022-19 - A Resolution fixing the date for a meeting on the proposition to authorize a Loan Agreement and the issuance of Notes to evidence the obligations of the City thereunder. All ayes. Motion carried. Date set for October 24, 2022, 6:00 pm, at City Hall. Motion by Pithan/Miller to approve Resolution 2022-18 Street Finance Report 2022. All ayes. MC General Election will be held on Tuesday, November 8, 2022, from 7:00 am – 8:00 pm, at City Hall. Next regular meeting set for Monday, November 7, 2022 at 7:00 pm at City Hall.
