City of Ute REGULAR COUNCIL MEETING June 6, 2022 – City Hall The Ute City Council met with Mayor Richard Hageman in regular, open session on June 6, 2022 at 7:00 p.m. Council members present: Becky Miller, Ciera Carlson, Ryan Pithan, Jimmy Carlson, and Matt Leitz. Also present: Kyle and Christy Schultz, Marvin Koch, Greg Iverson and Lonnie Carlson. Motion by JCarlson/CCarlson to approve the agenda. All Ayes. MC Vacant lots on Main Street were discussed. Motion by Pithan to go into closed session to discuss sale of real estate. Motion died for lack of a second. Clerk stated that the city attorney recommended approving a development agreement if considering selling lots for less than their assessed value. Motion by Miller/CCarlson to have attorney draft a development agreement for review at the next regular meeting for the sale of all 5 lots for a total of $50.00 to Kyle and Christy Schultz with the condition that development start within 1 year. All Ayes. MC Marvin Koch spoke during Public Forum about process for zoning change request and that he thinks a building permit should be submitted before a request to change the zoning. Leitz stated it wouldn’t make sense to pay to submit a building permit knowing it will get denied because of current zoning restrictions. If the zoning change request is approved a building permit will be submitted. Greg Iverson spoke during Public Forum. He requested a copy of the petition that was signed by 50% of the property owners within 350’ of the property requesting the zoning change and inquired if anyone could buy the empty lots on Main Street. Council informed him that anyone could buy the lots with an approved development agreement. Building Permits Approved: Leah Schwery – Concrete Pads. Lonnie stated he talked to Karl’s Chevrolet about trading in the city truck. Due to a change in body style the current snow plow mount would not work on the new truck and would have to be purchased new. They advised that they would not have prices for a new truck for a few months. Lonnie stated the price for a new standard bench to replace the one that is deteriorating at City Hall would be $450.00. 2022 Street Works Bids: Blacktop Service Company - $73,490.00; Knife River - $98,581.28; Barkley Asphalt - $56,000; Western Engineering – no bid received. Lonnie discussed the alley behind the school and getting a bid from Corey Abbott for putting in a gutter and rain box. Motion by Miller/Pithan to accept Barkley Asphalt bid of $56,000. All Ayes. MC Lonnie stated that copies of the CCR report were available at City Hall or at www.cityof ute.com. There were no violations last year. Motion by Pithan/Miller to approve the Consent Agenda. A. Approval of Minutes for April 4, 2022 Meeting B. Approval of April, 2022 Bills All Ayes. MC JEO Consulting – 2022 Water System Improvements Project Progress Report Motion by Pithan/Miller to approve Ahlers & Cooney, P. C. Bond Counsel Engagement Letter. All Ayes. MC Not to exceed to exceed $951,000 Water Revenue Capital Loan Notes: Motion by Leitz/CCarlson to approve RESOLUTION 2022–15- A Resolution fixing date for a meeting on the proposition to authorize a Loan Agreement and the issuance of Notes to evidence the obligations of the city thereunder. All Ayes. MC Triple C Pest Control mosquito spraying starts Tuesday, May 24, 2022, just before dusk and will continue for 16 weeks. Weather permitting. The General Primary Election will be held on Tuesday, June 7, 2022, from 7:00 am through 8:00 pm at City Hall The next regular meeting will be Tuesday June, 6, 2022, 7:00 pm at City Hall.
