City of Ute ORDINANCE 234- Summary of an Ordinance Amending the Code of Ordinances for the City of Ute, Iowa by Amending Title IV, Mental and Physical Health, Chapter 1, Animal Control of the City of Ute, Iowa and Adding 4-2 Urban Chickens. This is a summary of ORDINANCE 234 passed by the Ute City Council on June 9, 2025, and is effective today. A complete copy of the ordinance is available at the office of the City Clerk in Ute City Hall, 130 E Main St. Ute IA 51060, Monday 8am-Noon, Tuesday 8am – Noon, Wednesday 8am – 4pm, Thursday 8am – Noon. This ordinance dictates the following: 4-2-1 PURPOSE 4-2-2 DEFINITIONS 4-2-3 PERMIT REQUIRED – Permits require an annual application that also contains abutting property owner’s signatures. A fine will be imposed of $250 for keeping chickens without a valid permit. 4-2-4 NUMBER AND TYPE OF CHICKENS ALLOWED – Permits limited to 3 chickens, only female chickens. 4-2-5 NON-COMMERCIAL USE ONLY. 6. ENCLOSURES – setbacks and details for enclosure requirements. 4-2-7 ODOR AND NOICE IMPACTS. 4-2-. PREDATORS, RODENTS, INSECTS, AND PARASITES. 4-2-9 FEED AND WATER 4-2-10 WASTE STORAGE AND REMOVAL 4-2-11 CHICKENS AT LARGE – The Permittee shall not allow the Permittee’s chickens to roam off the permitted tract of land. Fines for Chickens at Large are: First Offense - $50.00; Second Offense - $100.00; Third and Subsequent Offenses - $200.00 4-2-12 UNLAWFUL ACTS 1. It shall be unlawful for any person to keep chickens in violation of any provision of this Chapter or any other provision of the Ute Municipal Code. 2. It shall be unlawful for any owner, renter or leaseholder of property to allow chickens to be kept on the property in violation of the provisions of this article. 3. No person shall keep chickens inside a single-family dwelling unit or multi-family dwelling unit(s). 4. No person shall slaughter any chickens within the City of Ute. 5. No person shall keep a rooster. 6. No person shall keep chickens on a vacant or uninhabited tract of land. 4-2-13 NUISANCES. Any violation of the terms of this Chapter that constitutes a health hazard or that interferes with the use or enjoyment of neighboring property is a nuisance and may be abated under the general nuisance abatement provision of Ute Municipal Code 3-2.
