NOTICE OF HEARING ON PROPOSED IMPROVEMENTS MCNEILL INTER-COUNTY DRAINAGE DISTRICT OF MONONA AND HARRISON COUNTIES, IOWA TO: Monona County Engineer, Harrison County Engineer, all owners, encumbrancers, lienholders, unknown heirs and claimants by will, to all whom it may concern, including the actual occupants of the land, or tract of land, described in and including the McNeill Inter-County Drainage District of Monona and Harrison Counties, Iowa. YOU AND EACH OF YOU ARE HEREBY NOTIFIED that the Joint Board of Supervisors of Monona and Harrison Counties, Iowa, acting as trustees on behalf of the McNeill Inter-County Drainage District in said counties has appointed Caleb Rasmussen, P.E. of ISG as an engineer to make surveys and investigations to determine the feasibility or the necessity of having repairs, and/or improvements, all concerning the drainage facilities of the McNeill Inter-County Main Drainage District in order to restore adequate drainage and relief for the lands included in said McNeill Inter-County Drainage District. YOU ARE FURTHER NOTIFIED that on July 12, 2022, a public hearing was held in which the Joint Board of Supervisors of Monona and Harrison Counties, acting on behalf of the McNeill Inter-County Drainage District approved a full cleanout of the Main Open Ditch as was detailed in the engineer’s report filed by drainage engineer Ivan Droessler of ISG on June 11, 2013. The cleanout was split into two phases, the first of which included a cleanout of the Main Open Ditch from the outlet up to the first Union Pacific Railroad crossing and completed construction in the Fall of 2024. The second phase has been delayed from permitting by the railroad. To continue with the Phase two plans a ditch bypass has been proposed which is detailed in the engineer’s report filed by Caleb Rasmussen of ISG on April 22, 2025. The engineer’s estimate of overall cost of improvements, right-of-way acquisition, and reclassification are as follows): Improvement Project Cost Subtotal: $338,080 Other Potential District Costs Engineering/ Permitting: $16,700 Right-of-way Engineering: $5,000 Taken ROW (14.0 Ac) & Severance: $161,000 Easement ROW (3 Ac.): $4,500 Damages: $7,225 Survey: $4,000 Additional Reclassification: $4,000 Warrant Interest: $93,000 Total Estimated Improvement Cost: $650,005 Remaining Phase 2 Repair costs: $845,232 Full improvement and remaining repair estimate of cost: $1,183,312 YOU ARE FURTHER NOTIFIED that this report with recommendations and updated costs is on file in the offices of the both the Monona County Auditor (610 Iowa Ave, Onawa, IA 51040) and Harrison County Auditor (111 North 2nd Avenue, Logan, IA 51546). The Report and cost estimate is viewable on the websites of Monona County www.mononacounty.iowa.gov and Harrison County www.harrisoncounty.iowa.gov or may be obtained via email by contacting the Monona County Auditor’s office at mocoaud1@mononacounty.org. Said report has been reviewed and considered by the acting Trustees with the Engineer’s recommended improvements found necessary and feasible. YOU ARE FURTHER NOTIFIED that the Joint Board of Supervisors of Monona and Harrison Counties, acting on behalf of the McNeill Inter-County Main Drainage District has fixed a time and place of hearing on said report and proposed improvements, on June 3, 2025, at 11:00 AM, at the Onawa Public Library located at 707 Iowa Avenue in Onawa, Iowa. At said hearing the Joint Board of Supervisors shall hear objections to the feasibility of such repairs and improvements of the drainage district as may be presented by and for any landowner in the District. The report of the engineer as filed may be amended before final action is taken thereon by this Joint Board of Supervisors. This hearing may be continued from time to time without further notice as determined by this Joint Board of Supervisors. YOU ARE FURTHER NOTIFIED THAT ALL OBJECTIONS TO THE ENGINEER’S REPORT OR TO ANY MATTER CONNECTED WITH THIS HEARING MUST BE IN WRITING AND FILED WITH THE MONONA COUNTY AUDITOR OR HARRISON COUNTY AUDITOR AT OR BEFORE THE DAY FIXED FOR HEARING. Any interested party may be heard in an argument by himself or by counsel. Anyone who fails to object in writing shall be held to have waived all objections and claims for damages. Any interested party may file a written supporting statement with the Auditor, at or before the date for hearing. YOU ARE FURTHER NOTIFIED that the Joint Board will also consider the interest rate for this project and may consider installment payments and length of time that assessments may be paid of not less than ten (10) nor more than twenty (20) years. YOU ARE FURTHER NOTIFIED that if you fail to object, the Joint Board of Supervisors can make a final decision to make repairs, improvements, acquire additional right-of-way, annex additional lands, and reclassify. As a consequence of your failure to object you lose your right to appeal the final decision within twenty (20) days to the Iowa District Court.
